Introduction

The only terms and conditions of contract between us (Biocleanse, a division of Quadralene Limited) and you (the purchaser and/or user of our website) will be those set out below, unless a Director of Quadralene expressly accepts other terms, in writing. By accessing or using this website you agree to these terms and conditions of use and all applicable laws governing use of the Internet. If you do not agree to these terms and conditions of use or the applicable laws, you may not use the site.

These conditions of sale will be governed by and construed in accordance with the laws of England and Wales. Only the courts of England will decide any disputes. If any of these conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining conditions which will continue to be valid to the fullest extent permissible by law.

Written Information

The information contained in the Biocleanse website, brochures, specifications, price lists or otherwise is provided “as is” for the purposes of information, guidance, education and communication only without warranty of any kind. To the extent permissible by law, we make no representations or warranties regarding the accuracy, reliability or completeness of the content of the Biocleanse website. We disclaim all warranties, express or implied including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. We make no representation that the Biocleanse site, or the servers that make them available are free of computer viruses.

Limitation of Liability

In no event shall Biocleanse be liable for any direct, indirect, special, punitive, incidental, consequential, exemplary or any other damages of any nature whatsoever arising out of, or in connection with, your use of, or inability to use, our website. Biocleanse has no duty to update the website or the content and we will not be liable for any failure to update the Biocleanse website. We are not liable for your use of other websites, which you access through certain links to websites owned and maintained by third parties. Links are provided as a service to users of the Biocleanse website and we do not endorse or warrant those third party owners or their websites.

Your responsibilities

Our products may be dangerous if they are not properly used, stored and the appropriate sensible precautions taken. You agree that you will undertake a risk assessment and take all the necessary steps that are reasonable and best practice, to eliminate or reduce any risk to health and or safety. You agree that you will indemnify us against any claim, proceedings, costs, loss, damage or liability suffered by you, or any third party, as a result of any failure by you to undertake the necessary steps to ensure appropriate health and safety.

Privacy

All use of your personal information will be made in accordance with our Privacy Policy.

Prices

  1. All goods will be supplied at the price and the VAT ruling on the date of despatch.
  2. All prices shown on the website and in brochures are ex works, net prices, excluding VAT and are for guidance only. We reserve the right to vary such prices at any time at our discretion.
  3. Quotations remain open for acceptance by you within 30 days of the date of the quotation, regardless of when the quotation is received by you.
  4. We reserve the right to establish minimum order quantities and/or minimum handling charges for any consignment.
  5. We reserve the right to make additional charges to cover the cost of all necessary packaging used for transporting our products safely.
  6. If the Purchaser is from outside the U.K. and is able to provide a valid EU VAT tax reference, goods will be supplied without VAT being added.

Payment

You can pay by Mastercard or Visa credit card, and Maestro debit card. Your credit/debit details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. You will not be charged for items until they are despatched. We accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape. Please ensure that the expiry date of your payment card is after the anticipated despatch date of your order. Payment is taken at the point of dispatch for goods and in the event that the payment card has expired we will be unable to take payment and fulfil your order. If payment is refused by a credit or debit card provider, we will have the right, without prejudice to our other rights, to recover from you the full costs of work in progress and administration.

Acceptance

At the moment that the goods are despatched, you will be charged for the goods. You will own the goods once they have left our premises and we have despatched them to you or the addressee. Ownership of the goods will pass to you in the United Kingdom. If goods are to be delivered outside of the United Kingdom, you or the addressee will be the importer of the goods into the country of delivery.

Delivery

  1. We will do our best to deliver by specified delivery dates. However, in all cases, delivery dates are estimates only and without commitment or obligation on our part. You will not be entitled to cancel any order, or to request a refund should delivery be made after the specified delivery date.
  2. If for any reason beyond our reasonable control, we are unable to supply a particular product, we will notify you, as soon as possible. We will be entitled to either terminate or suspend delivery without incurring any penalty.
  3. Unless otherwise agreed by us, orders will be delivered at your cost by whatever means we consider appropriate. If applicable, the cost of insurance, packaging, dock and airport dues, port rates and customs entry, freight and other charges, which may be incurred, are chargeable to you. Packaging and other containers are not returnable.
  4. You will be responsible for complying with any legislation or regulations governing the importation of the goods into the country of destination and for the payment of any relevant duties.
  5. We will be entitled to make delivery of goods in instalments and you will be obliged to pay for each instalment in accordance with our usual terms.
  6. If you fail to accept delivery within ten days of receipt of notice that the goods are ready for delivery, you will be liable for storage and other charges and we will be entitled, without prejudice to our other rights, to resell or otherwise dispose of the goods.
  7. Claims for shortages or damage to goods, must be made in writing within fourteen days of receipt.
  8. Claims for non-delivery of goods must be made in writing within fourteen days of receipt, by you, of our delivery advice. If we have not heard within fourteen days we will conclusively presume that you have received a satisfactory consignment.
  9. If we are manufacturing a special batch for you, we may deliver an excess or deficiency of up to ten percent of weight or volume ordered without any liability to you, except that the price will be adjusted accordingly.

Return of Product

We may accept back products that are returned as not being required, at our discretion. A minimum of 25% handling charge will be made and permission must be sought from our customer service department, before products are returned. We reserve the right not to make a refund when the contents or packaging are unfit for resale, or where the original batch numbers are unavailable. We reserve the right to charge a waste disposal fee on goods that are returned without permission, without the original batch number, or are contaminated. The cost of returning the goods will be at your expense.

Warranties and Liability

  • As long as you have followed the correct instructions, we will replace, free of charge, any goods, which you can establish are defective by reason of workmanship or materials and which are returned to us, carriage paid, with the batch number intact, within three months of the date of receipt by you.
  • No warranty is given that the goods are suitable for any particular or special purposes or for use in connection with any equipment unless expressly given in writing to you, at your normal address.
  • Where goods are sold by reference to descriptions in the website or brochures, the goods are sold subject to the tolerances and variations expressed or implied in writing. The design and source of raw materials may change from time to time and the Seller shall have the right to supply goods of an altered design, or from a new source of supply.
  • To the fullest extent permitted by law, we exclude liability in tort to you or to any third party. You undertake that you are a competent user of the class of goods supplied and that you have satisfied or are able to satisfy yourself that the goods are safe to use, and that you will institute a safe system of working for the use of the goods. You will indemnify us against any claim by any third party that the third party (or any fourth party on whose behalf the third party is acting) has suffered any loss, damage, personal injury or death by reason of or resulting from any negligence by us or any defect in the design, specification or manufacture of the goods.
  • We will not in any event be liable for any loss of profits or other financial or consequential loss whenever and however caused or arising in respect of products and services supplied by us. Subject to the previous paragraph and Clause (1) above, our liability for any loss or damage to property whatsoever will be limited to the price of the goods in question. This limitation of our liability will apply whether such damage or loss shall arise from any breach of this contract or from any breach of any condition or warranty implied by law or custom, or from misrepresentations by or the negligence of employees, our agents or us (save those of death or personal injury to human beings resulting from our negligence).
  • No sale by us to you will be deemed a sale by sample within the meaning of the Sale of Goods Act 1979.
  • Trademarks and Copyright

    All brand names, logos and trademarks are owned by Quadralene Limited. You may not use any of these without the written permission of a Director of Quadralene. You may not copy, modify, distribute, transmit, display, publish, create derivative works based on, transfer, license, or sell any content, graphics, or software from our websites, unless otherwise agreed in writing by a Director of Quadralene. If you ask us to manufacture a product to your specification, you will have to warrant that the formulation does not infringe the rights of any third party.

    This network of web sites is owned and operated by Biocleanse a division of Quadralene Limited. Biocleanse respects its visitors’ rights to privacy and developed this Privacy Policy to let you know how its sites operate and what kinds of information Biocleanse collects at its web sites.

    Biocleanse understands that some visitors to our web sites may be concerned about the online information they provide to Biocleanse and how we might use that information. This Privacy Policy addresses those concerns and summarizes what personally identifiable information Biocleanse may collect and how we may use that information.

Biocleanse will make reasonable efforts to comply with your request.

    This site uses Secure Socket Layer encryption in the transmission of all information. All pages on this Website have encryption protection. However, some pages to which you link from this site may not be encrypted. Biocleanse stores all personal and financial data in a private database that is not connected to the Internet. Although no systems or safeguards can be guaranteed as foolproof, our databases are protected from unauthorized access by firewalls, passwords and other mechanisms.

    Children’s Privacy

    Biocleanse believes that the privacy of children online should be protected.

    Biocleanse does not intend to, and does not knowingly, collect personal information from children under 13 years of age. If your child under 13 years of age has submitted personal information to Biocleanse online, and you would like to request that the information be removed, please send an email to enquiries@teknon.co.uk requesting Biocleanse remove the information submitted by your child online. Biocleanse will make reasonable efforts to comply with your request.

Biocleanse does not endorse or otherwise accept responsibility for the content or privacy policies of such third party web sites.     Biocleanse Data That May be Sent to Your Computer When you visit one of the Biocleanse web sites.
